Sign the Power of Attorney (POA)

There is a lot of trust involved here as you are signing your rights to someone you basically don’t know and many questions and concerns are raised. I know how you feel as I have a probate property in the UAE and need to sign a POA to the Lawyers to get a Grant from the UAE courts, to sell the property, and to send the money back to Thailand. Not easy and I have contacted dozens of Lawyers, had Zoom calls with them and over the past year nothing has happened. I am still waiting for an email, a contact, an update. Abroad Funerals get many calls regarding the price. Many will tell you an extremely low price and you may commit to this. However, there are many costs that you will know about later on. Police, Embassy, Morgue, transport, fees. Then the temple has 1, 4, or 9 monks, flowers, casket, wreaths, ceremony, electricity, water for guests, flowers, incense, etc. After, there are court fees to get a grant, Embassy fees for translation, courier fees.

In every presentation I do I request people to make a Will and they normally say I don’t have anything to benefit anyone – Well how wrong you can be as everyone has spent their life building something. Whether it be a bank account, a house, a business, a family it has taken years of hard sweat and time invested. Just being you on 100’s of databases needs fixing other wise bills could still be coming in and someone has to pay them!

The story below is tragic and as I tell my staff at Thai888 Legal – you need to think like a bank to fix probate problems – don’t think with your heart as the banks and other corporations don’t. They simply want their money and don’t care about you, the kids or where you end up.

Probate in other countries Thai888 Law

This is Jim from Australia with Thai888 law at the China embassy Bangkok. We were hired as Jim’s Chinese brother passed away in Thailand. Jim’s brother had a company in Thailand lived in Singapore and Shanghai. English Thai Chinese was used and 4 Embassies to get some vital docs we need to move ahead with probate in these countries. Thai888 Law and what happens if we close the company?

a rewrite of the Will is necessary when the Beneficiaries or the Executor changes and as we have the last Will on file it should not take long – bring in the changes and we can work something out

The question of what happens if Thai888 Law is no longer established –

As we made the Will it can be presented at court via another person with a lawyer

If I, Thai888 Law or anyone else is the deceased Executor then the court process is as follows:

the Will and documents regarding the demise of the above are presented to the court to prove the situation

the court (with evidence) approves the situation (effectively they have resigned as the Executor)

an application is made by another person or a court representative to fill the role of the Executor

the court approves this application and then appoints an Executor  and gives a Grant of Probate (court order)

the rules of probate are followed in that a period of challenges etc is allowed before the estate can be liquidated and proceeds repatriated to the Beneficiaries

This is what the banks require for closing down the deceased estate bank account and returning the money to the heirs – Thai888 Law has many years experience in Probate and we act for you. Please read the following instructions to retrieve 5000 USD from an account.

Please refer to requesting the closing of savings account number +++++++++++ and obtaining the remaining balance from such account of ++++++++++++++++++.

Per your request, please be advised that in order to receive the money, you are kindly requested to proceed with any one of the following three options:

1. Appoint your embassy as the recipient and request the embassy to provide the following documents to us. Under this option, we will issue a cheque (check) to the embassy with restrictive account payee only crossing.

1.1 A Power of Attorney appointing the embassy to execute the matter on your behalf.

1.2 A death certificate.

1.3 A copy of the passport of the legitimate recipient and the depositor.

1.4 A document showing that the recipient is a legitimate heir or administrator of the estate.

1.5 A letter from the embassy attesting that you are the legitimate recipient of the money.

1.6 A letter from Thailand’s Ministry of Foreign Affairs verifying the name and signature of the authorized officer of the embassy.

2. Appoint your embassy as a representative to proceed on your behalf by providing the following documents to the embassy in order to verify such documents and submit them to us. Under this option, we will transfer money to the designated account via SWIFT.

2.1 A Power of Attorney appointing the embassy to execute the matter on your behalf.

2.2 A death certificate.

2.3 A court order appointing an administer of the estate of the deceased.

2.4 A letter requesting money from the account of the deceased.

2.5 An application for currency exchange and fund transfer.

2.6 A letter of indemnity.

2.7 A copy of the passport of the legitimate recipient and the depositor.

2.8 A letter from the embassy attesting that you are the legitimate recipient of the money.

2.9 A letter from Thailand’s Ministry of Foreign Affairs verifying the name and signature of the authorized officer of the embassy.

All documents must be signed by your embassy.

3. Appoint a Thai888 law firm in Thailand to execute the matter on your behalf. The law firm must provide us documents in the same manner as described in No. 1 above. Under this option, we will issue a cheque (Check) to the embassy with restrictive account payee only crossing.

However, if you are able to travel to Thailand, you can file a case to request a court order appointing you as the administrator of the estate of the deceased. With this option, your documents must be notarized or verified by your embassy, and it may take up to two months to complete the matter.

Please be advised accordingly and keep us informed of your decision. Thank you.

One stop Law Company Thai888

I heard a comment today regarding a one stop company that does all legal work and the presenter said it was unwise to go to a company like that. Really? Thai888 Law prides itself on making it easier for the customer.

They then went on to say that they do everything? I had trouble following the presentation as it jumped from subject to subject.

I can think of many first class and expensive law companies in the Pattaya area that do everything including advertising screens and lock security boxes. These are value added services and it is great for the clients. I am all for it and I believe free enterprise and if you can get an edge on your competition then why not?

The part that made me chuckle is that Thai888 Law has 2 distinct offices that each handle very different work. Through our standard operating procedures (SOP) we can and do control all aspects of legal work in many provinces. If you have systems in place then you can complete any task no matter how complicated AND all under the SAME company banner.

Thai888 Law has expanded over the years into an international legal service. We have the people and the knowledge to deal with an overseas call from another law firm or a frantic relative wanting answers.

Don’t be misled as most of the large companies in the World have merged into a leaner, faster, more cost friendly consumer friendly organisation controlling all aspects of the product. You only have to look at your local Big C store and find that they no longer just sell food items but insurance, electrical items, household furnishings or in other words a one stop shop.

Thai888 Law offers everything to do with Legal Service. This is normal practice. If we get a job that needs a specialist Lawyer then we will retain one. However in 7 years this has never happened. One thing that really stands out is the need for English – a presenter and their company can loose all credibility when they stand up and say excuse me my English is not so good! I understand as my Thai is terrible – that’s why we have 4 English Thai staff and 1 native Australian CEO. If we need another language we have on many occasions used a smart phone to talk and answers questions with clients. I am amazed at how well this translator works an so I give Google and Samsung the thumbs up for their R&D.

Last there is a lot of radio talk at the moment on the taboo subject of death and how to handle it. I must say that Thai888 Law is coming up to its 7th year operating in Pattaya and during that time we forged relationships with Clive Monkhouse from the Allison Monkhouse Australian Company. Many things have happened during this time and one in particular was when Monkhouse had no presence in Thailand. Thai888 Law had been using and marketing the brand for many years thus proving our contractual arrangements with Monkhouse. As there was no Monkhouse, Thai888 Law absorbed this funeral and cremation work into its offices. We put people in place in Bangkok to deal with the Police Forensic Hospital and staff are trained to deal with the Embassies. Trained in arranging and making cremations as per the families request. Even sea burials. In a word we carried on. This relationship still stands although the Monkhouse banner is no more. All funeral, cremation, embassy work is done by Thai888 Law and office 10 is set aside for this work and the CEO Kelvin Bamfield controls this and the grant of probate. And yes we have a mostly female team that can handle things in a sensitive manner.
