Humble beginnings

Thai888 Law started off as a small business venture has now become 2 companies working together under the same management to streamline the legal issues that come with a foreigner passing away in Thailand. This allows clients to make 1 phone call to arrange all things to do with hospitals police morgue funeral embassy court probate. This unique model has evolved over many years as Thai888 Law began with 1 rented office and 1 staff member. Now our 2 offices has qualified legal and accounting staff that completed their degrees whilst working for Thai888.

Many of our clients living in Thailand make Living and Last Wills with us and unfortunately many pass away and in the old days we would outsource the funeral to Monkhouse Funerals. Various problems ensued with this system and to better manage this we registered Abroad Funerals Pattaya. With side by side offices we can arrange and manage everything all the way through to court grants and sending the assets back to the families. No other company does this in Thailand and reviews on our website show 5 stars and thankful messages from clients that also became friends during these stressful times.

Writing a Will that will stand up in court is not as easy as you think

The story is all to familiar in that a person to save a few bucks writes the Will themselves.

There are very specific legal terms like Testator, Beneficiary, Executor, Witnesses and if you dont know what they mean then dont write your own Will

Many English have accounts in the neighbouring countries to try to avoid the dreaded “Death Duties ” taxes of the United Kingdom and so in wanting to get the most return on money people save it in a tax haven country like the Isle of Man, Sheffield, Singapore, Hong Kong etc.

However the tax man has great patients and can wait until you die. Then the document you wrote comes into play to get the assets you worked so hard for and saved.

If the docs are not correct then your Beneficiary cannot get any of the assets you worked and saved. These offshore banks sit there while the Beneficiary or the Executor make challenges to get the money. They do not have to work with you and may ignore you.

It may take years.

You definitely will need legal assistance as there are many forms designed to find all the money and assets anywhere in the WORLD.

When writing your Will you should be aware of keeping assets in each country in a seperate Will – its not that expensive and will save thousands in legal bills and TAX.

Beware of hidden costs

Abroad Funerals get many calls regarding the price. Many will tell you an extremely low price and you may commit to this. However, there are many costs that you will know about later on. Police, Embassy, Morgue, transport, fees. Then the temple has 1, 4, or 9 monks, flowers, casket, wreaths, ceremony, electricity, water for guests, flowers, incense, etc. After, there are court fees to get a grant, Embassy fees for translation, courier fees.

Most importantly it makes sense to give a small quotation fee in the beginning, however the costs will add up. Because when people hear 60,000 baht they are shocked but this is approx 1500 GBP or 1900 USD or 2800 AUD for everything regarding the Funeral costs. This is way below the cost of another country. on 27 March 2018, the Emergency Decree on Non-Thais’ Working Management (No.2) (2018) (“Decree No. 2”) was issued. Decree No. 2 amended Decree No. 1.

Section 70 of Decree No. 1 (and the Act) provided that “a person who is granted permission for working may not carry out the work of the type, with the employer, in a locality or on any working condition that is different from that specified in their work permit unless permission under Section 71 is obtained.”

Section 71 of Decree No. 1 (and the Act) provided that “a person who is granted permission for working, and who intends to change or add the following particulars, must obtain permission from the Registrar: (1) type of work (2) employer (3) location or (4) working conditions.”

And Section 73 of Decree No. 1 (and the Act) provided that “no person may allow a foreigner to work in a manner different from the requirements specified in the work permit.”

However, and very significantly, Section 37 of Decree No. 2 repealed Sections 70, 71, and 73 of Decree No. 1.

Furthermore, Section 28 of Decree No. 2 provides that a work permit holder may engage in any work that is not specifically prohibited to all foreigners on the “Official List” of work prohibited to foreigners.

From Wills to Probate

I did a presentation at the Pattaya City Expats Club on Sunday regarding Probate and the pitfalls.

As soon as the video is available I will post it as there was some good facts in there and 4 case studies on what can go wrong with Wills and Probate.

Thai888 Law is now a complete office for making Wills, arranging funerals and cremations, applying to the courts for a Grant of Probate, repatriating funds back to the Beneficiaries.

The last 3 clients did not even come to Thailand and simply instructed us via email, SKYPE, phone to carry out their wishes. Family and friends can not always come to Thailand to arrange things and so we make sure everything is taken care of.

Embassy, hospital, release letters, translations from the Dept of Foreign Affairs, bank accounts, selling assets, selling house and condominiums are some of the issues we control from our 2 offices.

Thai888 Law had recent referrals from the UK Embassy to help out on foreigners that have unfortunately died in Thailand.

Due to family commitments or financial issues families and friends could not come to Thailand to manage the funeral and cremation of their loved ones.

A few phone calls to get their LINE Skype Messenger or Whats-app account then put us together and talking for as long as it took to resolve issues. Virtually free!!

Family then asks for an invoice to show whats necessary and the costs.

Once the money has been transferred into our account then we can start work with the Police, Morgue, Hospital, Embassy etc.

This has proved very efficient over the past 10 days.
