I am thankful to Joni, and my law team at Thai888 Law who helped me through from the minute ***** died, and he (Kelvin and Jeab) was the first person to meet me in the hospital and including proceedings regarding the WILL that ***** made with Thai888 in Thailand, and they fulfilled David’s promise to follow his WILL in Canada. 3 years passed and still the estate had not been finalized in Canada. Thai888 was asked for and supplied many documents and codicils to Canada Lawyers and then the tax office got involved. There were many delays until Kelvin requested the Ombudsman intervene as something was wrong and we needed action and not delays.

A Will document should be mandatory given the last 2.5 years we have been through with convid and the jabs. I say this as the last Will Testament is not only about your possessions or assets but about your body and who takes care of it, and the associated legal work
Embassy and Consulate procedures
There is a lot of red tape to follow and one issue that came about last week was, although this man was living out his twilight years in Thailand, he did not make a Will. He lived with his partner for over 10 years and thought that was good enough and she would take over when he passed. However there is no common law like this in Thailand.
Next of Kin or NOK
After he passed the Embassy was informed and they require the next of kin (NOK) to make the application for the letter of release (of the body) and as there was no listed next of kin, he remains in the morgue, until the Embassy can find someone to sign off on the docs require to make the funeral.

Corona Virus has destroyed 1000’s of businesses and peoples lives. For many months now many of our clients could not fly in to enjoy their condos, have a holiday, organise and attend a funeral for a friend or family member. It has been tragic and heart wrenching for many not being able to attend the farewell. Plus many pubs where people could meet for the “wake” were closed and so there were no stories and memories told.
Over the past year the families have asked me to do the speeches at the funeral cremation ceremony. Family and friends would send me emails of there friends life and funny times for me to read. My staff checked temperatures and wore masks and had the chairs spaced apart as per the law. As family and friends could not attend we did live video streaming and their reaction / feedback was wonderful (although there were up to 12 hours time differences). At least the family could see the farewell, the beauty of Thai temples that did the ceremony, the monks chanting and the water ceremony. On some occasions we even had Thai traditional dancing.
The main thing is that all can be arranged through us with a few calls and now with WhatsApp, Skype, LINE, Messenger, we can talk about the families wishes and all for free. Also, sending documents we need instantly for the family to print sign, scan and send back to us, is such am incredible advancement in technology.
Probate is where Thai888 applies to the court to manage the estate of the deceased
Due to Covid the courts have been closed for some months now and this has delayed many court applications and decisions. Before we could wait 3 months to get a court date and now this maybe longer. If this is the case and I am the Executor of the Will I personally advance the money to the hospital and all other bills that come in as we cannot wait to make the funeral happen. In some cases the family will transfer the money to us to clear the bill so that we can get all the documents we need to allow the funeral to progress.
One thing I have noticed is that due to Covid the amount of documentarian needed has increased and so please use an Executor to manage your Will properly as otherwise settlement will be delayed. Thai888 can be your Executor and please don’t listen to urban myths about Lawyers stealing all the assets as there are many laws to protect the Will, the Executor, the estate and Beneficiaries.
All Wills and the Executor have to be cleared by the court by testimony and then the court gives a Grant of Probate to unwind the estate and sell things, transfer property, close bank accounts.
The courts have made this process easier as the Executor is normally required to attend court however with Covid and not being able to fly in a Power of Attorney (POA) may be used instead.
It is a very complicated matter with the Police release, Hospital release, Embassy, Consulate, Letter of Release, transport, temple, cremation certificate, City Hall Death Certificate, translation, return of ashes. And this is just for the cremation. For those in the UK and due to the corona virus the following is offered.
Normally, the Will needs to be signed in the same room with the same pen and often a video or a picture is take to prove a few things.
Number 1 is that the person was competent, a key part of the Will.
Number 2 that there is no forgery as the Testator is signing the Will that can be clearly seen.
Many times Thai888 Law has drawn up a Will for a person living overseas and couriered this and a pen to the Testator so that they can used their witnesses in the same room at the same time and same pen.

Common Law in Thailand
Most of the time this is not recognised , however recently a Dutch man proved that he brought money into Thailand for the express purpose of building a house for his intended wife. The common law partner did not build the house and so the man took the matter to court and he won.
Keep your receipts says Thai888 law
When you bring money into Thailand for property you need a bank TT3. Why? because at some stage in the future you may need to sell you house and take the money out from Thailand. A TT3 for the same amount will let you do this. Also should you have issues then you can take the matter to court and produce the TT3 as evidence.
Pre Nuptial works with Thai888 Law
a prenup as they are commonly called simply states that what you bring into the marriage is yours and is not paid of the combined property and no claim is made on it, as both sign this doc and register it at the time of marriage. However whatever you make after marriage is considered 50/50 upon divorce. This include debts and so if either party runs up debts via gambling, accident, etc. then each party is responsible.

Corona Virus tough times to deal with a loved one passing. I am happy to say that Thai888 and Abroad are open and staff are fully employed. We are busy and have been rotating staff so that they can abide by the lockdown and visit their parents as 2 staff are now.
We have done 5 funerals in a week, all in the Pattaya area and NOT from corona virus but rather cancers. Still one of the leading causes of death around the World. With the lockdown it has been difficult to get to the Government Departments needed to supply the right documents to us.

I was seeking answers to the Corona Virus 19 CV19 and came across this video I was looking for why the death numbers were so distorted, why are the media using the crude death rates (CDR) and saying these are deaths from CV19 . Dont get me wrong as a lot of people are stressed and they may have lost a love one from an underlying illness, but the media is being reckless beyond words by fanning this as a pandemic. I honestly prey that Dr Shiva is correct! as I dont want to see the World like this again. Whole countries are being shut down and 100’s of 1000’s of companies and SME’s shut down and bankrupted. I didnt understand why as the CV19 is an infectious disease however it doesnt appear to be fatal unless theres is some underlying disease. An example is that most people will get CV19, and most will live through it if they have a healthy immune system. SAME AS the seasonal flu. This is why mostly elder people with lung, diabetes, blood pressure, liver, kidney issues dont make it.
The numbers in the press are combined deaths all over the World and this is wrong.
Example: The main causes of death that contribute to a lower life expectancy in males than in females are ischaemic heart disease (0.84 years), road injuries (0.47), lung cancers (0.40), chronic obstructive pulmonary disease (0.36), stroke (0.32), cirrhosis of the liver (0.27), tuberculosis (TB) (0.23), prostate cancer (0.22) . The media has all these crude death rates attributed to the CV19 as there is no reliable stats to support CV19 deaths only.
When I heard about the virus I too was stressed and wanted to run away. However we have Thai888 Law, our house and life here and so continued to work. I did however buy cod liver oil for all the staff, rich in vit A and D. Essential as you will see in the video. Anyway, the attached video is from Dr Shiva, who invented the email system we all use, he has several degrees and I was very impressed with his ability to join the dots for the many questions I had. Wow trying to stay positive however the air quality is very very bad and so you should have a breathing mask if you are outside for any length of time.
Air purifier for home or office
These are good machines as they detect bad air and filter it – you will sleep better and also give your lungs 7-8 hours to recover.
Air pollution, Chinese Corona Virus, Economy
Not looking good at all – many expats doing it tough as their currency is down against the Thai Baht. This means some are cutting back on necessities. However you should make a Will – this is cheap compared to the costs incurred if you don’t have one
This is happening now. A young man laying in hospital in a coma from a bike accident. There is no Living Will or Thailand Last Will, therefore no one can make decisions about this young mans future. There is no next of kin (NOK) and so the Embassy has to nominate someone to make decisions for this man via a power of attorney POA. The person nominated may be simply getting on with their life and may not need this responsibility. They may not want to travel to Thailand to take care of this case. Because when you think of it there is added expense, work and family disruption, airfares/hotel/taxi/translator and doing extremely difficult legal work in Thailand. The cost per day in the ICU hospital is 70,000 baht per day however if this young man had of made a Living or Last Will then someone could have managed this situation. For example the patient could have been moved to another (international) hospital at 40,000 baht per day. But unfortunately this is not the case. No documents and the patient just lies there.

Making a Last or Living Will is not about age as this person is in his 40’s and I have another friend in hospital with a stroke (age 43) – If you are riding a motor bike in Then this is the number 1 killer on the roads – you are gambling and need to make preparations with a Will – its not expensive. You may say “oh I dont have anything” and this is not true. You have your body and if something happens like the above someone needs to make decisions for you.
