Previously we had difficulty in acting under Power of Attorney POA for the Executor of a Will. The Judge mostly insisted on have that person fly in, stay in a hotel, get a translator, etc. But all that is changed now with the video links to the court
The only real issue is time
Thai888 Law appears in court at 9am and waits for the judge. However the person giving testimony from another country may have a large time difference and its AM for them. However it can be done and we have arranged this 10 times or more.
In the court are the Judge (or Judges), the lawyer, the translator and the person that may become the POA
Normally all goes well and the technology works.
This is a win win as many 1000s of dollars are save by no flights, hotels, etc. and because of the dreaded covid, it appears to meet the guidelines for the Laws of Thailand

Corona Virus has destroyed 1000’s of businesses and peoples lives. For many months now many of our clients could not fly in to enjoy their condos, have a holiday, organise and attend a funeral for a friend or family member. It has been tragic and heart wrenching for many not being able to attend the farewell. Plus many pubs where people could meet for the “wake” were closed and so there were no stories and memories told.
Over the past year the families have asked me to do the speeches at the funeral cremation ceremony. Family and friends would send me emails of there friends life and funny times for me to read. My staff checked temperatures and wore masks and had the chairs spaced apart as per the law. As family and friends could not attend we did live video streaming and their reaction / feedback was wonderful (although there were up to 12 hours time differences). At least the family could see the farewell, the beauty of Thai temples that did the ceremony, the monks chanting and the water ceremony. On some occasions we even had Thai traditional dancing.
The main thing is that all can be arranged through us with a few calls and now with WhatsApp, Skype, LINE, Messenger, we can talk about the families wishes and all for free. Also, sending documents we need instantly for the family to print sign, scan and send back to us, is such am incredible advancement in technology.
Probate is where Thai888 applies to the court to manage the estate of the deceased
Due to Covid the courts have been closed for some months now and this has delayed many court applications and decisions. Before we could wait 3 months to get a court date and now this maybe longer. If this is the case and I am the Executor of the Will I personally advance the money to the hospital and all other bills that come in as we cannot wait to make the funeral happen. In some cases the family will transfer the money to us to clear the bill so that we can get all the documents we need to allow the funeral to progress.
One thing I have noticed is that due to Covid the amount of documentarian needed has increased and so please use an Executor to manage your Will properly as otherwise settlement will be delayed. Thai888 can be your Executor and please don’t listen to urban myths about Lawyers stealing all the assets as there are many laws to protect the Will, the Executor, the estate and Beneficiaries.
All Wills and the Executor have to be cleared by the court by testimony and then the court gives a Grant of Probate to unwind the estate and sell things, transfer property, close bank accounts.
The courts have made this process easier as the Executor is normally required to attend court however with Covid and not being able to fly in a Power of Attorney (POA) may be used instead.
It is a very complicated matter with the Police release, Hospital release, Embassy, Consulate, Letter of Release, transport, temple, cremation certificate, City Hall Death Certificate, translation, return of ashes. And this is just for the cremation. Writing a Will that will stand up in court is not as easy as you think
The story is all to familiar in that a person to save a few bucks writes the Will themselves.
There are very specific legal terms like Testator, Beneficiary, Executor, Witnesses and if you dont know what they mean then dont write your own Will
Many English have accounts in the neighbouring countries to try to avoid the dreaded “Death Duties ” taxes of the United Kingdom and so in wanting to get the most return on money people save it in a tax haven country like the Isle of Man, Sheffield, Singapore, Hong Kong etc.
However the tax man has great patients and can wait until you die. Then the document you wrote comes into play to get the assets you worked so hard for and saved.
If the docs are not correct then your Beneficiary cannot get any of the assets you worked and saved. These offshore banks sit there while the Beneficiary or the Executor make challenges to get the money. They do not have to work with you and may ignore you.
It may take years.
You definitely will need legal assistance as there are many forms designed to find all the money and assets anywhere in the WORLD.
When writing your Will you should be aware of keeping assets in each country in a seperate Will – its not that expensive and will save thousands in legal bills and TAX.
I thought I would drop you a line with some flattering news, I gave our Wills to an acquaintance of ours who does a lot of work on wills for a large group of Lawyers, I wanted to take out the word Thai in regards to probate as all our investments are in Australia, he said you can do it yourself by filling out a Codicil form, which I will do, the main reason for this email is to say he was extremely impressed to the high standard of our Wills, he went on to say the standard of our Wills was far higher than in Australia in fact he hasn’t seen better including the quality of the paper, so I thought I would pass on his comments to you and especially to Jeab (thai888 law Director) who I believe put our Wills together, it’s good to see that the work coming out of your office is world class, you should put this on your wall so prospective clients become aware of who they are dealing with.

In every presentation I do I request people to make a Will and they normally say I don’t have anything to benefit anyone – Well how wrong you can be as everyone has spent their life building something.
