UK Wills please check if you live in Thailand

Wording and phrases

Last week in court the Judge questioned a UK Will in that the immovable property (the condo) was given to 2 of the heirs. Their name was specifically attached to this asset at 50/50 % each. However, the movable asset (money in the bank) was not allocated to these heirs and so the Judge request a family tree to show who is alive and who is not. The UK Will was drawn up in old English with bits of Greek thrown in to make it sound official. However, in a Thai Court with a Thai Judge hearing my testimony translated into Thai has was not convinced.

Lost in Translation

The issue was that the condo could be given to the Beneficiaries however the money in the bank was classified as residual and was needed to pay the bills, funeral, lawyers, etc. and what was left (residual) was to be given to who? The English Will was specific in this and stated that under section 41 of UK Law that all debts be settled by the Trustees (Executors) however Thailand does not have trusts or trustees – but rather controllers of property where the heir of Beneficiary is under age.

Thai always takes precedence over another language

Thai Courts, Thai Property, Thai laws and not UK or any other countries Law. However, Thai Courts will sometimes rule if another country has already ruled in favour in their own country. This is a precedence that can have weight in the case in Thailand if another international court has already determined the verdict. But still clarification is needed.

Our Wills are designed for Thailand, although we do make international Wills, and are in Thai and English. Our Wills are proof read and signed off by the Testator (the person making the Will) and this shows they understand what their wishes are and that the are of sound mind (competent) to make this legal document. Thai888 Wills can involve other countries assets however should you pass away then international laws may come into play, overseas taxes etc. You may want to consider separating the Wills are this will stop any legal issues after you pass. Remember in the UK over a certain amount of money could attract a 40% tax. You can talk to us about this should you have an issue

Then when you’re happy we will print it out, you come to sign, all is bound together with your picture (showing your competent) and signed by 2 witnesses in our legal offices. Then and only then do you pay.

Don’t say you have nothing and so don’t need a Will

This is wrong thinking as your body is in a foreign country and so the Embassy/Consulate, Police, Morgue, Hospital, Next of Kin, Temple, ashes, etc all need to be taken care of and when there is a Will in place and an administrator to contact it makes everything much easier.

Why no Last Will Testament mandate

A Will document should be mandatory given the last 2.5 years we have been through with convid and the jabs. I say this as the last Will Testament is not only about your possessions or assets but about your body and who takes care of it, and the associated legal work

Embassy and Consulate procedures

There is a lot of red tape to follow and one issue that came about last week was, although this man was living out his twilight years in Thailand, he did not make a Will. He lived with his partner for over 10 years and thought that was good enough and she would take over when he passed. However there is no common law like this in Thailand.

Next of Kin or NOK

After he passed the Embassy was informed and they require the next of kin (NOK) to make the application for the letter of release (of the body) and as there was no listed next of kin, he remains in the morgue, until the Embassy can find someone to sign off on the docs require to make the funeral.

Fail to Plan , Plan to Fail

A little bit of planning would have saved all this and so PLEASE make a Will, particularly if you live in a foreign country. THANKS

Normally people have assets and a beneficiary to give their assets to. If you don’t make this doc then you run the risk of decisions and your assets going to another unintended person

I am in the same position

At Thai888 Law we have many procedures that are like a production line. Sign the Power of Attorney (POA)

There is a lot of trust involved here as you are signing your rights to someone you basically don’t know and many questions and concerns are raised. I know how you feel as I have a probate property in the UAE and need to sign a POA to the Lawyers to get a Grant from the UAE courts, to sell the property, and to send the money back to Thailand. Not easy and I have contacted dozens of Lawyers, had Zoom calls with them and over the past year nothing has happened. I am still waiting for an email, a contact, an update. There is no follow up from them and this makes me very nervous. Thai888 Law does not work this way. We send you a complete breakdown of costs, procedures, and any questions you need answers to.

Its strange to have a law office and a funeral service

No its not, we have 2 offices, one for the civil criminal company family matters and one for Abroad Funerals and Probate. This works very well as both are entwined and compliment each other. Example. When someone dies there are many docs issued including a POA, and these are Notarised (we can do this as we have lawyer notaries), Embassy letters, translation, banks transfers, legal authority to work for you to make the funeral cremation probate seamless and transparent. Don’t forget there is insurance as well and they’re a tricky bunch

I thought I would drop you a line with some flattering news, I gave our Wills to an acquaintance of ours who does a lot of work on wills for a large group of Lawyers, I wanted to take out the word Thai in regards to probate as all our investments are in Australia, he said you can do it yourself by filling out a Codicil form, which I will do, the main reason for this email is to say he was extremely impressed to the high standard of our Wills, he went on to say the standard of our Wills was far higher than in Australia in fact he hasn’t seen better including the quality of the paper, so I thought I would pass on his comments to you and especially to Jeab (thai888 law Director) who I believe put our Wills together, it’s good to see that the work coming out of your office is world class, you should put this on your wall so prospective clients become aware of who they are dealing with.

Wow trying to stay positive however the air quality is very very bad and so you should have a breathing mask if you are outside for any length of time.

Air purifier for home or office

These are good machines as they detect bad air and filter it – you will sleep better and also give your lungs 7-8 hours to recover.

Air pollution, Chinese Corona Virus, Economy

Not looking good at all – many expats doing it tough as their currency is down against the Thai Baht. This means some are cutting back on necessities. However you should make a Will – this is cheap compared to the costs incurred if you don’t have one

THAI888 Living and Last Will

This is happening now. A young man laying in hospital in a coma from a bike accident. There is no Living Will or Thailand Last Will, therefore no one can make decisions about this young mans future. There is no next of kin (NOK) and so the Embassy has to nominate someone to make decisions for this man via a power of attorney POA. The person nominated may be simply getting on with their life and may not need this responsibility. They may not want to travel to Thailand to take care of this case. Because when you think of it there is added expense, work and family disruption, airfares/hotel/taxi/translator and doing extremely difficult legal work in Thailand. The cost per day in the ICU hospital is 70,000 baht per day however if this young man had of made a Living or Last Will then someone could have managed this situation. For example the patient could have been moved to another (international) hospital at 40,000 baht per day. But unfortunately this is not the case. No documents and the patient just lies there.

Making a Last or Living Will is not about age as this person is in his 40’s and I have another friend in hospital with a stroke (age 43) – If you are riding a motor bike in Then this is the number 1 killer on the roads – you are gambling and need to make preparations with a Will – its not expensive. You may say “oh I dont have anything” and this is not true. You have your body and if something happens like the above someone needs to make decisions for you.

You may think “oh its easier for someone else to look after” not true as the situation above is costing 70,000 baht per day. This burden belongs to someone

Emotions aside

I think Carrie’s review sums it up perfectly. This emotional time when things need to be done and you’re in the wrong space. It is a very legal process starting with the Embassy needing a document from the blood relative to release a letter to Abroad Funerals to start the funeral process.

English or Thai Language

Apart from everything being in Thai language you will need to be very patient with the locals as things are done differently in Thailand.

Thai888 Law domain up and running

Monday saw all of our mail systems thai888.com down. We could receive emails but could not send as for an unknown reason. I called our domain hosting service Godaddy in Singapore. This did not help. It became its not our problem but they did try to help.

Email issues

The second call was to TOT Thailand and some techs came out on Tuesday. A few hours later they showed me a screenshot of the Singapore server rejecting thai888.com emails.

Godaddy or TOT

Call back to Godaddy in the USA, where nearly an hour later I was getting angry as no sleep for a day and no email for 2 days.

Again Godaddy rejected that it could be their Singapore servers, although I had the screenshot of the servers rejecting thai888.com mail!

So we have Singapore, Thailand, USA and me being an Australian trying to solve the blame game with me in the middle saying I have to run a company and staff and clients emails aren’t getting through.

In the end, it was not a Godaddy issue according to them nor TOT issue and so.

In the end, I did something very radical. I moved (migrated) our thai888.com domain and all things to the USA.

6 hours later I got a messaging saying migration was completed. Then I reconfigured all the mail and certificates for SSL to show USA domain hosting.

BTW my prior life I was the IT manager of Central Queensland University in Sydney NSW Australia and with this knowledge, I was able to fix this international issue. And so I hope something like this doesn’t happen to you as without technical knowledge it would be hard to diagnose the problem.

I tend to forget sometimes that I am dealing with real living people and their emotions and bodies. Making a Will or enforcing a Living Will after doing it hundreds of times makes it sometimes impersonal and robot-like. After all, it is a legal document. But for some they want their legacy to live on through a charity or helping their Thai partner, their family or sometimes even the gardener or the cook.

When a Will is made it normally stats that the person making it is of sound mind. However, my experience lately is that some of my clients have or are developing Alziemers. These people are elderly and living alone.

Alzheimer’s is a dreadful decease and most debilitating. And the worst is that each day it shows and the person forgets many things, even why they are in my office.

The disease gets to a point where the person needs 24-hour care. Care that is not really available in Thailand and so the person takes whatever assistance they can get. Someone to just be there in case.

The carer may mean well but they have no experience in looking after someone with Alzheimer’s. None.

I am not saying this of all carers but one client has an awful lot of money missing from their account. The carer was given the PIN number and access as sometimes the client cannot get out of bed and needs supplies. Each day several withdrawals have been made.

A lot of trust is needed here. It’s not easy and what else can one do in this situation?

If you know someone in this position then get them to make a Will whilst they are still competent.

Also, try to make them understand that someone needs to look after their accounts, someone trustworthy.

If the person has a large estate or more than 2 bank accounts, get them to start reducing all things down to a manageable size. 2 bank books – 1 fixed interest and the other day to day should be enough. And don’t forget the 800K in the bank for Immigration. And to go every 90 days and to apply for your visa every 12 months.

Not easy when you can’t remember much at all.

I did not ever expect this to be part of my job. However, I can help in a few ways. I am the controller of property for may clients, meaning that should something happen I can control the asset if it is for a person under 20 years old.

I can help if you have a Living Will or the Last Will and I am the Executor.

I cannot help if you have nothing in place and no next of kin.

Therefore I ask you to make a Will and make sure that a trusted 3rd party has your access codes and PIN numbers – and I don’t mean the gardener or the cook as the temptation is too great.
