Failed loan and how to get your money back

An interesting case Thai888 Law civil case against an individual in Ubon Ratchathani in the North East of Thailand.

The case involved the use of a Chanote (Land Title Deed) to secure a loan.

To cut a long story short the monthly payments stopped after a short time and then the Chanote was returned.

However the Chanot was forged.

So there are 2 issues here:

to get the money back an application was made to the Civil Court in Ubon as thats where the event took place

the forgery becomes a criminal matter and was referred to the Criminal Court, again in Ubon

The civil matter was listed and has been been running now for 2 years and the Chanote was finally given to the lender of the money. However, when presented to the Land Office in Ubon, the issue was treated as if the Chanote was lost and so many documents were submitted to get the correct lenders name on the Chanote. This will take 6-8 weeks before the name on the Chanote is changed and then sold.

At least 8 trips were made and so be prepared for a long fight:

costs were for a lawyer to attend court

flights to Ubon

hotel

taxis

etc.

So far only a few hearings at the Criminal Court and this means another 4-6 trips to Ubon to sort this out.

Legal issues can be resolved in your favour as long as you have all the docs things should go your way.

However be prepared for a long costly battle but when you get back whats rightfully yours then its a big win.
