Making a Living or Last Will Testament with Thai888 Law 2021

I just finished watching a short video on making a Last Will and Testaments and frankly I was a little confused by the jargon used, and so i think most of you would be confused as well. This is my job full time at Thai888 Law and so I hope to take any confusion out.

I live and work in the Pattaya area and know many people that have businesses, family and overseas assets that they want to protect should something happen to them.

Many people call and say its a simple Will and shouldn’t take to long or complicate things. It usually takes a few days to draft something for you and then after you’re OK it then we print it for you to sign. Most of the time things go well and occasionally not so well as if the Will is badly written there could be court cases later

What could legally go wrong

For a start trying to write your own Will is OK but what if you miss a word or a phrase or signature. This opens the door to court action later.

I did a talk at the Pattaya Expats Club (PEC) and the Pattaya City Expats Club (PCEC), in fact many talks, about Murphy’s Law and this is simply “Anything that can go wrong will go wrong”. But if the Will is properly written then chances are if it goes to court you will win.

The most important person in the Will

This would have to be the Executor as they are the managers of the Will after you die. They need to take the Will to court and give testimony to say they are a fit and proper person to manage the Will. This person in order to get to court has to apply through a Lawyer and the Lawyer gets a court date for them. They appear in Court and normally the judge gives them the power to go to the bank and close the accounts, go to the land office and change the name on the Chanote (Title Deed), sell the cars and bikes, pay the bills and donate items to charity. There is a lot of work and all the docs require a legal person, plus someone that speaks, reads and writes Thai. World wide assets

Definitely DONT put this in your Will as there are something you need to talk to me about before you do. There are different laws around the World and so you don’t want the lawyers fighting over whos law to follow. Revoke other Wills

Another DONT, as if you have any property in another country, and a Will to cover it and it says revokes (takes away its power) all other Wills and Codicils (additions) then these maybe used to cause an issue in the courts, and the winners will be the Lawyers, Solicitors, tax man.

You dont need to pay big money for a Will

Appointment

First of all send me an email and I will send you a checklist of what docs we need to draw up and translate the Will. The checklist covers your property, who is the next of kin (NOK), who gets the property in your Will (Beneficiary), and who is the manager (Executor) of your Will, who to contact in Thailand and in your home country, your Embassy. All names, addresses and contacts are included and of course should something happen to any of the above, we list alternative people (this makes the Executors job easier) as well.

Making your friend the Executor

This might seem like and honor to nominate your friend however, its a lot of work and a lawyer has to be involved too, and in most cases they will resign from the role as they don’t have the knowledge or language to deal with these government departments. Resigning is another step in the court process and not necessary if you write the Will properly in the first instance.

Registering the Will

This is no longer necessary. You will receive a signed copy of the Will and the other goes to the Executor. Keep then in a safe place. We can scan your signed Will and send to other people involved.

Executor of the Will

I have heard people at the various clubs say the Lawyers acting as the Executors steal all the assets. I understand the Law and there are approx 66 of them that are concerned with the Will, the Executor, the Beneficiaries and the assets and so it is not easy to steal anything. There is a solution to this and so have a co Executor. As, in some cases the other co executor is over seas and cannot come to the court case in Thailand and the other Executor can act for them. Under Thai Law these people are responsible for each other.

For those in the UK and due to the corona virus the following is offered.

Normally, the Will needs to be signed in the same room with the same pen and often a video or a picture is take to prove a few things.

Number 1 is that the person was competent, a key part of the Will.

Number 2 that there is no forgery as the Testator is signing the Will that can be clearly seen.

Many times Thai888 Law has drawn up a Will for a person living overseas and couriered this and a pen to the Testator so that they can used their witnesses in the same room at the same time and same pen.

Corona Virus Thailand

Sorry to say that Tour groups have stopped coming to Thailand until the 4th Feb 2020 in an attempt to contain this virus.

I have been reading about it for a week now and in particular the CDC reports and some old SARS reports from people that were closely involved 17 years ago.

What can you do?

There are a combination of things however with a virus some advice is to wash your hand all the time. Try not to touch your face or eyes. I have been avoiding places that host tourists and tours ie hotels, tourist attractions, etc.

Personally, it reminds me that we will not be here forever and so get your house in order. Meaning that you should have documents that direct others to your wishes should something happen to you.

I know this sounds like a cheap plug for us and thats why I say you do not have to make your Wills with Thai888 Law. You can go anywhere but please make something.

In every presentation I do I request people to make a Will and they normally say I don’t have anything to benefit anyone – Well how wrong you can be as everyone has spent their life building something. Whether it be a bank account, a house, a business, a family it has taken years of hard sweat and time invested. Just being you on 100’s of databases needs fixing other wise bills could still be coming in and someone has to pay them!

From Wills to Probate

I did a presentation at the Pattaya City Expats Club on Sunday regarding Probate and the pitfalls.

As soon as the video is available I will post it as there was some good facts in there and 4 case studies on what can go wrong with Wills and Probate.

The last 3 clients did not even come to Thailand and simply instructed us via email, SKYPE, phone to carry out their wishes. Family and friends can not always come to Thailand to arrange things and so we make sure everything is taken care of.

Europe and Thai888 Law Company

I received a call last week from a woman asking about cremation costs in Thailand as her Uncle had died.

Being a very busy professional woman she need to arrange her life and work to make time to come to Thailand to make arrangements for her Uncle’s ashes to be carried back to EU.

This is of course possible with the right documents.

First, Thai888 arranged the Embassy to give us a letter of release. This can only be arranged after the Embassy has received from from the Niece 1 Power of Attorney (POA) in English and 1 POA in Thai, plus a signed copy of her Passport.

Having done this we can then arrange with the Forensic Hospital in BangkoDerek Playfor deceased 2018k to collect the Death Certificate (DC), body and cremate it at the temple.

Next step is to take the ashes back to Pattaya for the Niece to take back to the EU.

At the same time Thai888 Law takes the documents to the Department of Foreign Affairs to have the Thai documents translated into English.

The Niece can then pack the ashes in her luggage and declare with Immigration and Customs that she is transporting items correctly.

Also we have arranged with the Police to get the personal property of the deceased back to the family.
