UK Wills please check if you live in Thailand

Wording and phrases

Last week in court the Judge questioned a UK Will in that the immovable property (the condo) was given to 2 of the heirs. Their name was specifically attached to this asset at 50/50 % each. However, the movable asset (money in the bank) was not allocated to these heirs and so the Judge request a family tree to show who is alive and who is not. The UK Will was drawn up in old English with bits of Greek thrown in to make it sound official. However, in a Thai Court with a Thai Judge hearing my testimony translated into Thai has was not convinced.

Lost in Translation

The issue was that the condo could be given to the Beneficiaries however the money in the bank was classified as residual and was needed to pay the bills, funeral, lawyers, etc. and what was left (residual) was to be given to who? The English Will was specific in this and stated that under section 41 of UK Law that all debts be settled by the Trustees (Executors) however Thailand does not have trusts or trustees – but rather controllers of property where the heir of Beneficiary is under age.

Thai always takes precedence over another language

Thai Courts, Thai Property, Thai laws and not UK or any other countries Law. However, Thai Courts will sometimes rule if another country has already ruled in favour in their own country. This is a precedence that can have weight in the case in Thailand if another international court has already determined the verdict. But still clarification is needed.

Our Wills are proof read and signed off by the Testator (the person making the Will) and this shows they understand what their wishes are and that the are of sound mind (competent) to make this legal document. Thai888 Wills can involve other countries assets however should you pass away then international laws may come into play, overseas taxes etc. You may want to consider separating the Wills are this will stop any legal issues after you pass. Remember in the UK over a certain amount of money could attract a 40% tax. You can talk to us about this should you have an issue

Then when you’re happy we will print it out, you come to sign, all is bound together with your picture (showing your competent) and signed by 2 witnesses in our legal offices. Then and only then do you pay.

Don’t say you have nothing and so don’t need a Will

This is wrong thinking as your body is in a foreign country and so the Embassy/Consulate, Police, Morgue, Hospital, Next of Kin, Temple, ashes, etc all need to be taken care of and when there is a Will in place and an administrator to contact it makes everything much easier.

Estate management is complex

Your Wills are written in a particular way so as to abide by the Thai Law and the Judgement of the courts. 95% of the outcomes are as the Testator (writer of the Will) wished. However, when the Testator has passed away, they cannot defend themselves or their wishes. This is why Thai888 Law has their own court proven way to make sure the Will is as intended.

Court Grant of Probate

This states who is the Executor or administrator of the estate. The Grant is necessary to close bank accounts, close companies, sell properties of land, condominiums, cars, bikes, shares, Bitcoin, etc. Also the Executor may need to go to court to defend the estate as others may make a claim although they may not deserve it.

Dying in Thailand

Thai888 Law has Abroad Funerals Co. to make this easier for grieving families overseas and not able to get to Thailand. We have dozens of cases regarding the need to liquidate the estate this way. A Power of Attorney POA is given to us to deal with the Embassy of the deceased, to make the funeral, cremation, return the ashes to the family, and then apply to the courts for a Grant to do the Probate.

International Tax

Be careful how you write your Will and carefully state its for Thailand assets only and that it is not Worldwide and does not revoke other Wills and Codicils –

International Tax

The UK and USA for example, may, have their own probate system and they will want to add your assets to the big pool and then tax accordingly. If you have assets in another country then you will need the Death Certificate translated and certified at the MOFA and then this can be used in another countries probate. There are many issues and so you may need professional advice. It is relatively cheap insurance for the future.

The courts opened last week after a lock down and so we could get some of our civil cases (probate) heard. In all cases we were successful in getting a court grant to enable us to then wrap up the estate and send the residual (money) to the Beneficiaries both in Thailand and overseas. We are very grateful to the judge in understanding that the Executor of the Will could not fly into Thailand due to covid and in granting that I could act as the Executor for the Estate

This is of great benefit as it saves time, money, quarantine time, stress and the risk of spreading covid

Under normal circumstances when I got the news he had left us I would have been on a plane in person but this was not possible. What could I do? It was Songkran and the embassy was closed. From the FCO they gave me the list of regulations and papers that were needed and Ray died without leaving an executor . How could I manage all that remotely from Switzerland?.
And then I found you and you took all that worry away from me. You knew exactly what needed to be done and I immediately felt safe, secure and confident that you and your team would take care of everything. And you did beyond my expectations will all the calmness and respect for a family grieving for the loss of their loved one. Perfect in fact.

Corona Virus Thailand 2021 and how to legally protect

My work is made simple as Thai888 Law and Abroad Funerals has qualified staff to do the work for you. Corona has made it difficult in some ways.

We have in house qualified Lawyers, Funeral staff, Embassy contacts, police, hospital contacts and can arrange the cremation funeral repatriation by our own Abroad Funerals Company.

Corona Virus has destroyed 1000’s of businesses and peoples lives. For many months now many of our clients could not fly in to enjoy their condos, have a holiday, organise and attend a funeral for a friend or family member. It has been tragic and heart wrenching for many not being able to attend the farewell. Plus many pubs where people could meet for the “wake” were closed and so there were no stories and memories told.

Over the past year the families have asked me to do the speeches at the funeral cremation ceremony. Family and friends would send me emails of there friends life and funny times for me to read. My staff checked temperatures and wore masks and had the chairs spaced apart as per the law. As family and friends could not attend we did live video streaming and their reaction / feedback was wonderful (although there were up to 12 hours time differences). At least the family could see the farewell, the beauty of Thai temples that did the ceremony, the monks chanting and the water ceremony. On some occasions we even had Thai traditional dancing.

The main thing is that all can be arranged through us with a few calls and now with WhatsApp, Skype, LINE, Messenger, we can talk about the families wishes and all for free. Also, sending documents we need instantly for the family to print sign, scan and send back to us, is such am incredible advancement in technology.

Probate is where Thai888 applies to the court to manage the estate of the deceased

Due to Covid the courts have been closed for some months now and this has delayed many court applications and decisions. Before we could wait 3 months to get a court date and now this maybe longer. If this is the case and I am the Executor of the Will I personally advance the money to the hospital and all other bills that come in as we cannot wait to make the funeral happen. In some cases the family will transfer the money to us to clear the bill so that we can get all the documents we need to allow the funeral to progress.

One thing I have noticed is that due to Covid the amount of documentarian needed has increased and so please use an Executor to manage your Will properly as otherwise settlement will be delayed. Thai888 can be your Executor and please don’t listen to urban myths about Lawyers stealing all the assets as there are many laws to protect the Will, the Executor, the estate and Beneficiaries.

All Wills and the Executor have to be cleared by the court by testimony and then the court gives a Grant of Probate to unwind the estate and sell things, transfer property, close bank accounts.

The courts have made this process easier as the Executor is normally required to attend court however with Covid and not being able to fly in a Power of Attorney (POA) may be used instead.

It is a very complicated matter with the Police release, Hospital release, Embassy, Consulate, Letter of Release, transport, temple, cremation certificate, City Hall Death Certificate, translation, return of ashes. And this is just for the cremation. Abroad Funerals get many calls regarding the price. Many will tell you an extremely low price and you may commit to this. However, there are many costs that you will know about later on. Police, Embassy, Morgue, transport, fees. Then the temple has 1, 4, or 9 monks, flowers, casket, wreaths, ceremony, electricity, water for guests, flowers, incense, etc. After, there are court fees to get a grant, Embassy fees for translation, courier fees.
