To assure all clients that have a Last Will made at Thai888 Law Company.
There are 5 kinds of Last Wills in Thailand. The Lawyer at a recent presentation was referring to a closed envelope Will. This is for one type of Will and this does not apply to all Wills. It is not mandatory to make a Will this way.
Wills made for Thai888 clients are Section 1659 – Wills made outside the Amphoe Office. It is perfectly legal and has been tested many times in Thai Courts without any problems.
Under section 1659 Will is where the Testator signs, 2 witnesses sign at the same time. The Beneficiary(s) is named and the Executor is named.
After the Will is drawn up with the Testators passport details, the Beneficiaries details, the named Executor, the assets photocopied, the Testator signs in front of the 2 witnesses.
This document can then be scanned and given to the Testator as well as a hard copy of their Will. One copy is kept in our office for future reference.
A lawyer is not needed to draw up the Will.
The lawyer is only involved when the Testator dies, then a Plaint is written by a lawyer to apply for a court date. After a court date is given then all documents, the Will, the Executor appear in court. The courts then decide if the Will is valid and the Executor are able to do the work required.
The main point here is that a Lawyer is not needed until the final court process. So this saves you a lot of money.
