It is perfectly legal in Thailand to have a Living Will. However you need to be aware that it is a directive that you set up before hand to tell the doctors, hospital, staff NOT TO keep you alive on a machine, NOT TO force feed you, etc. It is not to tell the hospital that you are sick of living and want them to terminate your life by drugs or another method.

There are 2 legal conditions that activate the LW

You must be in a terminal phase of illness ie cancer and dying or brain dead after a stroke or accident. Health Act part 12.

A stay in hospital could run at 70,000 baht per day and this will soon deplete your savings. This is not to say you should not be in hospital seeking treatment, however you might get the same treatment at another hospital much cheaper. But without having a directive of some kind there is no way your proxy can have you moved to a cheaper hospital. You are powerless.

2.1 A Power of Attorney appointing the embassy to execute the matter on your behalf.

2.2 A death certificate.

2.3 A court order appointing an administer of the estate of the deceased.

2.4 A letter requesting money from the account of the deceased.

2.5 An application for currency exchange and fund transfer.

2.6 A letter of indemnity.

2.7 A copy of the passport of the legitimate recipient and the depositor.

2.8 A letter from the embassy attesting that you are the legitimate recipient of the money.

2.9 A letter from Thailand’s Ministry of Foreign Affairs verifying the name and signature of the authorized officer of the embassy.

All documents must be signed by your embassy.

3. Appoint a Thai888 law firm in Thailand to execute the matter on your behalf. The law firm must provide us documents in the same manner as described in No. 1 above. Under this option, we will issue a cheque (Check) to the embassy with restrictive account payee only crossing.

However, if you are able to travel to Thailand, you can file a case to request a court order appointing you as the administrator of the estate of the deceased. With this option, your documents must be notarized or verified by your embassy, and it may take up to two months to complete the matter.

A few highlights were that Kelvin said “just make a Will” you dont have to come and see us. But make sure you get it right and put everything together in a book.

Also that its not “Bad Luck” to not make a Will. Rather it is good luck as then you do not put the burden on others to do the Probate, as this demands a court appearance and is a lot of work for your friend or family.
