Making a will is an important decision for anyone, but it is especially important for expats.

This is because expats often have assets in multiple countries, and the laws governing inheritance can vary from country to country.

If you die without a will, your assets may be distributed according to the laws of the country in which you die. This means if you are not officially married your partner may not receive any benefit.

Especially if the will is badly written and contested in court. A will can help to streamline the probate process and make it easier for your loved ones to inherit your assets.
  • Banks. the Land Office, the Embassy, property in your own country, pensions, savings etc. all require a document from the court (a Grant of Probate) to release these properties to the people you want to give them to.

A Will is critical for smooth passage on many things. First is the arrangement of a funeral cremation burial, as it nominates who is in charge of this, and that is the Executor.

Second is passage through the court systems and again the Executor or the administrator plays a critical role in success.


The Executor MUST know what they are doing and 99.9% don’t. DONT name your friend as the Executor as you think its some badge of honor. It is not and it is a very legal matter with hospitals, police, family and embassies involved.


OUR LAST FUNERAL WAS DELAYED AS THERE WAS A HOSPITAL BILL TO PAY BEFORE THE RELEASE OF THE BODY. THE DELAY WAS 4 WEEKS.

Leon Casey UK deceased – Jomtien Thailand Thai888 Law Co

Thai888 Law firm is seeking the UK address of Leon Casey deceased. Leon died in Pattaya Thailand in 2022. We contacted the UK Embassy in Bangkok and they had no info on Leon and he remained in the morgue for over 50 days before we could cremate him. The delay was caused by having no info on Leon or next of kin to contact. We have since been making application for probate however we don’t have an address of his property in UK Guildford and so cannot list it as an asset. Can you advise us of the address of the property and if it is tenanted? I am aware of the privacy laws however we have run out of avenues to contact. UK Wills please check if you live in Thailand

Wording and phrases

Last week in court the Judge questioned a UK Will in that the immovable property (the condo) was given to 2 of the heirs. Their name was specifically attached to this asset at 50/50 % each. However, the movable asset (money in the bank) was not allocated to these heirs and so the Judge request a family tree to show who is alive and who is not. The UK Will was drawn up in old English with bits of Greek thrown in to make it sound official. However, in a Thai Court with a Thai Judge hearing my testimony translated into Thai has was not convinced.

Lost in Translation

The issue was that the condo could be given to the Beneficiaries however the money in the bank was classified as residual and was needed to pay the bills, funeral, lawyers, etc. and what was left (residual) was to be given to who? The English Will was specific in this and stated that under section 41 of UK Law that all debts be settled by the Trustees (Executors) however Thailand does not have trusts or trustees – but rather controllers of property where the heir of Beneficiary is under age.

Thai always takes precedence over another language

Thai Courts, Thai Property, Thai laws and not UK or any other countries Law. However, Thai Courts will sometimes rule if another country has already ruled in favour in their own country. This is a precedence that can have weight in the case in Thailand if another international court has already determined the verdict. But still clarification is needed.

Don’t say you have nothing and so don’t need a Will

This is wrong thinking as your body is in a foreign country and so the Embassy/Consulate, Police, Morgue, Hospital, Next of Kin, Temple, ashes, etc all need to be taken care of and when there is a Will in place and an administrator to contact it makes everything much easier.
