Notarize documents

How to get documents notarised

In fact the content of the documents is not being notarized by the Lawyers. It is the person that is sitting in front of the Notary and that Notary witnesses them signing, also also stating that they look like their identification picture of their passport or ID Card.

Apostille documents

In many cases involving Government docs an Apostilled stamp is needed and these can only be done at an Embassy or Consulate. These are embossed stamps. numbered and signed off by the Minister.

What kind of stamp do i need

Normally the company or person wanting verification of the person states clearly who shall be able to make the notary statement or give the stamp. Note the name, commission expiry date and the state or area of the Notary.

Normally another document is added to make a statement

Thai888 Law has 5 Notaries

Please make an appointment should you want anything notarised. It would also help if you could explain what the docs are or even better send a picture of the doc, so that we can advise you on if a Notary or an Apostille is needed.

Will writing, Probate and preserving your wealth through Thai888 Foundation

Many times I get a call asking how much is a Will or I have written my own and can you take a look at it.

Yes I can and I do. From my experience, I see many things that the Judge at the Probate hearing will question me or the Executor on. Many people say well I have a Will in my country and so that is enough or I don’t have anything and so what does it matter. Or let someone else take care of it as I will be dead.

Are you dying tomorrow or in the next 20 years, as the Will is “at the time”

Most people (Testators) don’t understand that the Will is written today and may last for 20 or more years. During that time, your life will change. Your assets may grow or you may be left something through someone else’s Will or you may get married and have children. Don’t laugh as I know several guys that retired in Thailand, found a new lease in life and a new spark and started a family. You may become senile, suffer a stroke or heart attack, Alzheimer’s, Parkinson’s, or an accident, that leaves you incompetent. Therefore, when making a Will it should be written to cover existing and future assets and people. It states at the time that you were competent and is good enough for the courts.

Thai language in the Will

If you live in Thailand then you know that things can get lost in translation very easily. A well written Will can save many issues, time and money later on. Thai888 Law has excellent translators on staff, that will translate the Will into Thai, send you a copy in Thai and English so that you understand the last contract you will ever be involved with. You can read this, understand it and sign it in front of our legal staff, with proof that you are competent to enter into this contract. This makes it hard to contest.

Children and their future under inheritance

Children are protected under the law. However, making your child an heir to your assets is prudent of you, in wanting to protect their future life possibly without you. However, the children need to be protected by a controller of property until they are 20, then they can manage their own affairs and finances. The controller is usually the mother, and in some cases not the best choice, as they have no experience in managing your estate and your childs legacy. Therefore we offer Thai888 Foundation as the controller of property to safeguard the assets and your children’s future.

Thai888 Foundation

came about as in many cases where I handle probate or in writing the Will the Testator (you) wishes to safeguard the asset to look after the Childs schooling, food, housing, etc. and the Foundation can do this if you leave the assets in your Will to Thai888 Foundation or make a donation before you pass away. There are no trusts in Thailand available to us and so this is the next best asset protecting vehicle, until your child reach the age of 20 then they can inherit the balance. The Foundation is fully Government checked and is monthly accountable and audited every 12 months. There is a board of directors (3) to keep the Foundation running ethically, morally and accountable. There is one Australian Director Kelvin Bamfield that has lived in Thailand 24 years and is a founding member of Thai888 Law, Abroad Funerals Thailand and Thai888 Foundation. Kelvin has extensive experience in both local and international Law and Probate Law in particular and considers Thailand to be his home. Kelvin can call upon the many legal staff to solve any issue and litigate any matter in court.

Old Age and who will look after you

Many clients worry about when they get old who is going to take care of them and in an honest professional way. When one’s memory fades and someone says I will look after you, well, in some cases this doesn’t last long, as the money runs out fast, as its not manage properly. Parkinson’s or Alzheimer’s is a slow creeping decease and forgetting PIN numbers, account logins, user names is all part of getting old. In many cases this personal information is given to someone and this is not always a good thing, as you might forget and then the next thing all your savings are gone. Thai888 Foundation can assist you in this matter and can secure you now and in your future. Don’t forget you are a foreigner in another country and whatever family you have left, may not care to look after you in your old age. email [email protected] as we can help.

Donate to Thai888 fondation

many people when making their Wills leave a % to the Thai888 Foundation. However, should you want to assist others whilst you are still alive, then you can legally donate some money to us now. This helps with our minimal overheads, to helps others, and is good karma for you. Many of my clients already donate to the larger charities and thank you for this. However, these large charities have many overheads and this is opposed to Thai888 Foundation thinking. All of our donations go to our 3 member board for allocation to those that will go on to making themselves and their families lives better. It is seed money donations to make the Thai families become self sufficient. This is in keeping with the thoughts and plans of the late great Rama 9 King of Thailand. Self sufficiency was one of his pet projects, and he wrote many books on this philosophy. In a small way we are keeping in line with these teachings. https://thai369.com/en/the-ro-sustainable-development-is-thailand/

Self Sufficiency & Thai888 Foundation

For example, King Rama 9 recommends that each farmer divide his farm into four, with 30 % dedicated to growing rice, primarily for family consumption, with the surplus to be marketed, 30 % dedicated to building a water reserve to be able to meet agricultural needs even in the event of drought, 30 % dedicated to food crops, vegetable garden, fruit trees, but also breeding of chickens, ducks, cows and buffaloes, both for the family’s food and the production of natural fertilizers for the crops and finally 10 % for housing and access to the farm. Thus, he gives a very practical and accessible illustration of his theory.

This method of charity allows the Thai people to not exist on a hand out, but rather be productive and have self worth and pride.

Conclusion

Thai888 Foundation does not simply hand out money and move on. We seed small farms to give the local Thai people the first few steps up and a head start in building a small producing farm. That produce goes to market and is then reinvested back into the farm. Each cycle the farms output increase and lifts the welfare of the farm owners until they become self sufficient. This should take 6 to 12 months.

Making a will is an important decision for anyone, but it is especially important for expats.

This image has an empty alt attribute; its file name is cropped-thai888-law-5-star-reviews-2023.jpg

This is because expats often have assets in multiple countries, and the laws governing inheritance can vary from country to country.

If you die without a will, your assets may be distributed according to the laws of the country in which you die. This means if you are not officially married your partner may not receive any benefit.

This may not be the way you want your assets to be distributed, and it could lead to a lot of confusion and conflict among your loved ones. This may not be the way you want your assets to be handled, and it could lead to a lot of confusion and conflict among your loved ones.

A will allows you to specify who you want to get (inherit) your assets, and it also allows you to appoint a guardian for your children if you die while they are still minors. This is called the controller of property and Thai888 Law is in the process of starting up a Foundation to assist in these matter.
A will can also help to ensure that your assets are distributed quickly and efficiently after your death. Normally applying to the courts and settlement could take 6 months.

Here are some of the specific benefits of making a will as an expat:

  • You can specify who you want to inherit your assets. This includes both your loved ones and any charities or organizations that you support.
  • You can appoint a guardian for your children if you die while they are still minors. This at the moment is a Controller of Property and its not entirely a good situation as this person may also die. This will ensure that your children are cared for by someone you trust. Our Foundation is being set up to do this.
  • You can choose the way in which your assets are distributed. For example, you can choose to leave your assets to your loved ones in equal shares, or you can leave a larger share to one person. Or a charity or a foundation that can manage the assets into the future.
  • You cannot avoid the probate process in Thailand. The probate process is time-consuming and can be expensive, and it can also be emotionally draining for your loved ones. Especially if the will is badly written and contested in court. A will can help to streamline the probate process and make it easier for your loved ones to inherit your assets.
  • Banks. the Land Office, the Embassy, property in your own country, pensions, savings etc. all require a document from the court (a Grant of Probate) to release these properties to the people you want to give them to.

If you are an expat, it is important to make a will as soon as possible. This will help to ensure that your assets are distributed according to your wishes, and it will also help to protect your loved ones after your death.

Here are some tips for making a will as an expat:

  • Choose an attorney who is familiar with the laws of the country in which you live. This would be award winning Thai888 Law, also dealing in international probate matters.
  • Make sure that your will is in writing and that it is signed and witnessed by two people. In Thailand this is normally in Thai and English so all parties can understand it.
  • Keep your will in a safe place where your loved ones can find it after your death. Normally a copy is held in Thai888 Law offices.
  • Review your will regularly to make sure that it still reflects your wishes. Should you buy or sell any assets we simply attach this to your will, free of charge.

Making a will is an important step in estate planning, and it is especially important for expats. By following these tips, you can ensure that your will is valid and that your wishes will be carried out after your death.

Ensure your hard earned assets are safe. Make a Will with Thai888 Law Co. the best Will writers and Probate Law people in Thailand as awarded.

A Will is critical for smooth passage on many things. First is the arrangement of a funeral cremation burial, as it nominates who is in charge of this, and that is the Executor.

Second is passage through the court systems and again the Executor or the administrator plays a critical role in success.

The Executor MUST know what they are doing and 99.9% don’t. DONT name your friend as the Executor as you think its some badge of honor. It is not and it is a very legal matter with hospitals, police, family and embassies involved.

OUR LAST FUNERAL WAS DELAYED AS THERE WAS A HOSPITAL BILL TO PAY BEFORE THE RELEASE OF THE BODY. THE DELAY WAS 4 WEEKS.
DON’T LET THIS HAPPEN. I CAN ACT AS THE EXECUTOR OF HAVE DONE SO FOR MANY YEARS. AS THE EXECUTOR I PAY ALL THE BILLS TO STOP DELAYS.

I cannot say enough how My wife and I appreciate all that you have done for us after our son’s passing in Thailand. The funeral arrangements were perfect, how you handled the paperwork for bringing his remains home and dealing with the probate was done in such a professional manner. We can’t thank you enough and would recommend you services to others with similar unfortunate circumstances.

Thank you so much

Leon Casey UK deceased – Jomtien Thailand Thai888 Law Co

Thai888 Law firm is seeking the UK address of Leon Casey deceased. Leon died in Pattaya Thailand in 2022. We contacted the UK Embassy in Bangkok and they had no info on Leon and he remained in the morgue for over 50 days before we could cremate him. The delay was caused by having no info on Leon or next of kin to contact. We have since been making application for probate however we don’t have an address of his property in UK Guildford and so cannot list it as an asset. Can you advise us of the address of the property and if it is tenanted? I am aware of the privacy laws however we have run out of avenues to contact. If you cannot help us can the local police assist us? regards Kelvin Thai888 Law Thailand – [email protected] = So far we have contacted many Government offices in the UK and regretfully they state that due to privacy issues they cannot give us any information.
